Terms and Conditions of Service

These Terms and Conditions ("Agreement") govern access to services provided by Henrik Bolte Co., Ltd. ("we" or "DOODIN") on the website and application. By accessing the services, the user, or user of the platform (collectively referred to as "you"), confirms that you have read and accept all the terms, policies, and conditions outlined in this Agreement.

1. Definitions​

“DOODIN” refers to the platform or marketplace that allows sellers to list land and other properties for sale, and enables buyers to search for such listings through the website and online application.

“Products” refers to land and other real estate.

"Buyer” refers to the purchaser or agent of the purchaser of real estate listed on our platform.

“Seller” refers to the seller or agent of the seller of real estate on our platform.

“Contract” refers to the contract of sale for real estate.

2. Our Services​

We are a marketplace that provides an online platform for the listing and sale of products between buyers and sellers through the website and application called DOODIN. We are not involved in any contractual agreements between buyers and sellers and do not accept any obligations related to such contracts.

3. Use of Services​

(1) Registration

We need to collect personal information for registration and service access. You warrant that such information is accurate, complete, truthful, and current. We are not responsible for the loss or damage of such information. You must set a user account name and password for service access and are responsible for maintaining the security of your account name and password. You agree not to disclose these to any third party. You may not transfer, lease, lend, or grant access to this account to others.

(2) User Capacity

  • a. You warrant that you are of legal age to use the services and can legally bind this Agreement. We may suspend service access without prior notice if the user is under the legal age. If you are a minor, you warrant that you are using the services with consent from your parent or guardian, who has read and understood this Agreement. By granting consent, your parent or guardian agrees to be bound by this Agreement and accepts responsibility for the actions of the minor while using the services.

  • b. If you use the services as a representative of a legal entity or organization, you warrant that you have the authority to bind such entity or organization to this Agreement.

(3) Personal Data Protection

The Privacy Policy (link to Privacy Policy: https://www.hbolte.com/legal/privacy-policy) explains the use of personal data and its protection when using the services and is part of this Agreement. By using the services:

  • a. You warrant that the information is accurate, complete, and current, and you will not claim or sue us if the personal data you entered is incorrect, incomplete, or outdated. You agree to notify us immediately if such information is incorrect, incomplete, or outdated so we can correct it.
  • b. You consent to our collection, use, disclosure, or processing of your content and personal data as described in the Privacy Policy.

(4) User Conduct

You may use the services as long as you comply with this Agreement and the law, with the following limitations:

  • a. Do not impersonate another person or provide false personal information.
  • b. Do not copy, distribute, modify, reverse-engineer, dismantle, hack, alter, destroy, steal data, or disrupt the operation of DOODIN.
  • c. Do not distribute viruses, worms, Trojan horses, spyware, phishing, or spread any software or programs that may harm or control the operation of DOODIN.
  • d. Do not use the services for illegal purposes, including but not limited to uploading, posting, forwarding, or displaying content, messages, images, symbols, or marks that are defamatory, obscene, offensive, hateful, infringing, threatening, fraudulent, or harassing others.
  • e. Do not use the services or upload content inappropriately, fraudulently, unethically, falsely, misleadingly, or deceptively.
  • f. Do not alter product prices or interfere with other users' listings.
  • g. Do not upload, post, or forward content that infringes on the patents, trademarks, trade secrets, copyrights, or other intellectual property rights of others.
  • h. Do not upload, post, or forward spam, chain letters, ponzi schemes, investment frauds, or engage in any other illegal activities.
  • i. Do not use the services to violate the privacy of others or to stalk or harass others.

(5) Seller Responsibilities

  • a. You must select the option for paying land transfer fees as detailed in the listing creation section.
  • b. You warrant and guarantee that you upload, post, or list products that are accurate and genuine.
  • c. You warrant and guarantee that you upload, post, or list the sale of products that are fully owned or legally represented by the owner of the rights to upload, post, or list the sale of the products.

(6) Reservations of Rights

  • a. We are not liable for violations of the agreement by third parties whom you have allowed, instructed, or permitted to access the service through your account, and we reserve the right to pursue legal claims in the event of damages arising from such actions.
  • b. We are not responsible for your public posts or private shares, and we do not guarantee the accuracy, completeness, or quality of such content.
  • c. We are not liable if you encounter content that is defamatory, abusive, rude, hateful, infringing, threatening, deceptive, harassing, or otherwise inappropriate, fraudulent, unethical, untrue, misleading, or involved in scams, chain letters, ponzi schemes, investment frauds, or any other illegal activities.
  • d. We are not responsible for the uploading, posting, or sharing of content that infringes intellectual property rights.
  • e. We reserve the right to screen, deny, delete, or move any content that violates or breaches any terms of this Agreement.
  • f. We reserve the right to temporarily or permanently suspend services or cancel user accounts if we find that you have violated any terms of this Agreement.
  • g. We reserve the right to disclose your account information and content to government authorities as required by law or by court order.

(7) Reporting Content

  • a. If you find and believe that any content violates intellectual property rights or breaches this Agreement or is illegal, please notify us by sending evidence to support@hbolte.com.
  • b. If you are a copyright owner or a licensing organization or an entity authorized to manage copyrighted works on behalf of the copyright owner and you believe that your rights or the rights of the licensed copyright owner under your management have been violated, please notify us by sending evidence to support@hbolte.com.

4. Intellectual Property​

4.1 Company Rights​

  • a. All works and trademarks appearing through DOODIN, including but not limited to texts, graphics, logos, and images, are copyrighted by us or other copyright owners and are protected under copyright law, trademark law, and other applicable intellectual property laws.
  • b. Unauthorized use, reproduction, modification, distribution, or display of the creative works and trademarks mentioned in section 4.1(a) is prohibited without our written consent or that of the copyright owner.

4.2 User Rights​

  • a. By publishing content in our service, you grant us a worldwide license that is non-exclusive, royalty-free, and transferable, to use, reproduce, publish, create derivative works, and publicly perform or display that content for advertising and service provision purposes, in whole or in part.
  • B. You grant other users a worldwide license that is non-exclusive, royalty-free, and transferable, to use, reproduce, publish, create derivative works, and publicly perform or display content as specified in section 4.2(a).
  • c. The rights under sections 4.2(a) and 4.2(b) cease when your content is deleted from DOODIN.

5. Fees and Payments​

  • a. We charge service fees from sellers based on the type of service fee for each account type, processed through Google Play and the App Store, with fee rates (including VAT) and details as specified in the terms and conditions at the link https://doodin.hbolte.com/pricing/.
  • b. Payment of fees will be processed through Google Play and the App Store.
  • c. You may request a refund through Google Play and the App Store and can cancel your subscription at any time, subject to Apple and Google’s conditions.

6. Content Deletion and Account Suspension​

  • a. We may notify and delete any content or information you upload or post on DOODIN that is believed to violate this Agreement or is illegal, and we will delete your account from DOODIN if it is found to be a severe violation of this Agreement. You may submit an appeal with evidence, such as proof of ownership or rights to the products being sold, for instance, a copy of your ID or land title deed, and we may request additional documents for verification.
  • b. If your account is suspended for violating this agreement or engaging in other illegal actions, we reserve the right not to refund fees. In other cases, you may request a refund through the App Store and cancel your subscription at any time, subject to Apple and Google’s conditions.

7. Standard Agreement​

(1) Warranty Disclaimer

We do not guarantee service in cases such as:

  • a. Damage or disruptions that occur during system use due to force majeure, internet or public telecommunications network failures, or failures of your own computer system or devices that cannot support our website and application.
  • b. Data leaks within the system not caused by our internal infrastructure or by the fault of our employees, staff, or agents. If you find a data leak, you must notify us immediately upon discovering any data leakage so that we can investigate and restrict access to the affected data.

(2) Limitation of Liability

Under the provisions of the law, we are not liable for:

  • a. Loss of profits, revenues, business opportunities, goodwill, or any anticipated savings;
  • b. Damage or loss of data, whether resulting directly or indirectly;
  • c. Punitive damages arising from errors or inaccuracies in the system;
  • d. Injury or property damage resulting from your actions while using the service;
  • e. Viruses disseminated by third parties and any data entering the computer system or being deleted or rendered unusable by you.

(3) Indemnification

Under the provisions of rights recognized by law, you agree to hold the company, its employees, directors, and agents harmless from all civil liabilities and agree to indemnify for damages arising from:

  • a. Fraudulent intent, breach, or any other intentional or grossly negligent acts that violate the law;
  • b. Breach of this Agreement;
  • c. Violation of third-party rights, such as copyrights, ownership, or privacy rights;
  • d. Damage to third parties resulting from your use.

This agreement is binding and remains effective throughout your use of the service.

(4) Modification

We reserve the right to amend or change this Agreement at any time, with changes taking effect immediately upon posting the revised version on the website and application. We will notify you while you are using the service, and clicking to accept the Agreement will be considered as your acceptance of the amended terms.

(5) Assignment

You agree not to assign your rights and obligations under this Agreement without our written consent. Any assignment in violation of this agreement shall be void.

(6) Waiver

If you fail to comply with this Agreement and we do not take immediate action, this does not mean that we are giving up any rights that we may have.

(7) Severance

If any part of this Agreement is deemed void or unenforceable by law, that specific provision shall be considered ineffective, while the remaining provisions shall continue to be valid and binding.

(8) Governing Law

This Agreement is governed by and interpreted in accordance with Thai law. In the event of a dispute regarding rights or claims under this Agreement or from the use of the platform's services, legal action shall be subject to the exclusive jurisdiction of the courts of Thailand.
